Terms and Conditions

These Terms and Conditions ("Terms," "Terms of Service," or "Agreement") govern access to and use of the Vizito service operated by Individual Entrepreneur VIKTOR ROZENKO, identification number 345782879 ("Vizito," "we," "us," or "our").

By accessing or using Vizito, you agree to these Terms. If you do not agree, you must not access or use Vizito.

These Terms apply to:

  • the Vizito website at vizi.to;
  • appointment-booking pages created using Vizito;
  • accounts created by independent medical specialists;
  • individuals who use Vizito to request or manage appointments;
  • people who book appointments on behalf of another person;
  • communications with our support team; and
  • related Vizito services and functionality.

1. Introduction and acceptance

1.1 These Terms form a binding agreement between you and Vizito.

1.2 By creating an account, accessing a booking page, requesting or managing an appointment, uploading a document, or otherwise using Vizito, you confirm that:

  • you have read and understood these Terms;
  • you accept these Terms and our Privacy Policy; and
  • you have the legal capacity and authority to enter into this Agreement.

1.3 If you use Vizito on behalf of another person, organisation, or practice, you confirm that you are authorised to bind that person, organisation, or practice to these Terms.

1.4 These Terms should be read together with our Privacy Policy, which explains how personal data is collected, used, stored, shared, and protected. Where these Terms address privacy matters, the Privacy Policy governs the details.

2. Definitions

In these Terms:

  • "Vizito," "we," "us," or "our" means Individual Entrepreneur VIKTOR ROZENKO, identification number 345782879, operating the Vizito service.
  • "Service" means the Vizito website, booking pages, scheduling functionality, and related features.
  • "Specialist" means an independent medical specialist who registers for and operates a Vizito account.
  • "Patient" means an individual for whom an appointment is requested or managed through the Service.
  • "Booker" means a person who requests, books, cancels, reschedules, or otherwise manages an appointment, whether for themselves or for another authorised person.
  • "User," "you," or "your" means any person who accesses or uses the Service, including Specialists, Patients, Bookers, and visitors.
  • "Booking page" means a public page created by a Specialist through which appointments may be requested.
  • "User content" means information, listings, text, images, documents, and other material submitted to or through the Service by a User.
  • "Privacy Policy" means the Vizito Privacy Policy published at vizi.to.

3. Eligibility and accounts

3.1 Eligibility

3.1.1 You may use the Service only if you can form a legally binding contract with us under applicable law.

3.1.2 A person under the age legally required to provide valid consent should not independently use the Service to provide personal or health-related information unless permitted by applicable law. Appointments concerning minors are addressed in section 6.4 and in the Privacy Policy.

3.1.3 The Service is currently intended primarily for Specialists operating in Georgia and the Dominican Republic. People and Specialists in other countries may be technically able to access the Service, but Vizito does not currently represent that the Service is specifically adapted to, officially supported in, or legally compliant with the healthcare or professional regulations of every country.

3.2 Account registration

3.2.1 Certain features require a Specialist account. When you register, you agree to provide accurate, current, and complete information and to keep it up to date.

3.2.2 Access to your account is authenticated by email sign-in links ("magic links") sent to your registered email address. You are responsible for maintaining control of and securing access to your email account, for keeping your registered email address accurate and current, for not forwarding or sharing sign-in links, and for all activity that occurs under your account.

3.2.3 You must promptly notify us of any suspected unauthorised access to or use of your account.

3.2.4 You may not share, sell, or transfer your account, or allow another person to use your account, except as expressly permitted by us.

4. Description of the Service

4.1 Vizito is an appointment-booking and scheduling platform intended primarily for independent medical specialists.

4.2 The Service allows Specialists to:

  • create a public booking page;
  • publish their services, prices, location, and availability;
  • receive appointment requests;
  • manage appointments;
  • accept documents uploaded by Patients or Bookers;
  • provide downloadable calendar files and links for adding appointments to calendar applications; and
  • communicate appointment-related information by email.

4.3 The Service allows Patients and Bookers to:

  • view a Specialist's published services, prices, location, and availability;
  • request, book, cancel, or reschedule appointments;
  • upload documents that a Specialist has requested or is authorised to receive; and
  • receive appointment-related communications by email.

4.4 Vizito provides administrative and scheduling software only. Vizito is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. Vizito does not supervise, direct, or take part in the relationship between a Specialist and a Patient.

4.5 We may modify, add, or remove features of the Service at any time, as described in section 18.

5. Specialist obligations and responsibilities

5.1 Accuracy of listings

5.1.1 A Specialist is responsible for ensuring that information published on their booking page — including professional title, biography, services, service descriptions, prices, location, working hours, and availability — is accurate, current, lawful, and not misleading.

5.1.2 Vizito does not independently verify every Specialist's qualifications, licences, professional registration, or right to practise.

5.2 Licensing and qualifications

5.2.1 A Specialist represents and warrants that they hold all licences, registrations, qualifications, and authorisations required to offer the services they publish and to practise in their jurisdiction.

5.2.2 A Specialist is responsible for ensuring that their use of the Service complies with all laws and professional requirements applicable to them, including healthcare, professional-conduct, advertising, consumer-protection, tax, and data-protection requirements.

5.3 Professional and medical-record duties

5.3.1 The Specialist is solely responsible for the provision, quality, and appropriateness of any medical or professional services delivered to a Patient.

5.3.2 The Specialist is responsible for obtaining any legally required consent for treatment, for maintaining professional confidentiality, and for meeting all medical-record obligations.

5.3.3 The Service is not intended to serve as the Specialist's permanent medical-record system unless expressly stated otherwise. The Specialist should export or separately retain any information they are legally or professionally required to maintain as part of a medical record. Retention periods are described in the Privacy Policy.

5.4 Data-protection role

5.4.1 As described in the Privacy Policy, where a Specialist uses the Service to collect and manage information about Patients or appointments, the Specialist ordinarily acts as the data controller and Vizito ordinarily acts as the Specialist's data processor or service provider.

5.4.2 The Specialist is responsible for identifying and documenting an appropriate legal ground for collecting and using health-related and other personal data, and for providing Patients with any required privacy information.

5.5 Lawful use

A Specialist must use the Service only for lawful purposes and in accordance with these Terms, the Privacy Policy, and any additional guidance we provide.

6. Patient and Booker obligations

6.1 Accurate information

Patients and Bookers must provide accurate, current, and complete information when requesting or managing an appointment, and must not impersonate any person or misrepresent their identity or authority.

6.2 Appropriate document uploads

6.2.1 Users should upload only documents that are reasonably necessary for the relevant appointment and that the Specialist has requested or is authorised to receive.

6.2.2 Users must not upload:

  • unrelated medical records;
  • unnecessary identification documents;
  • payment-card information;
  • passwords;
  • documents relating to another person without authority;
  • unlawful content; or
  • information that is not necessary for the appointment.

6.3 Authority to book for others

6.3.1 A Booker may request an appointment for another individual only where they are authorised to do so, including where they are the person's parent or legal guardian, an authorised caregiver, a legal representative, acting with the person's permission, or otherwise legally entitled to arrange the appointment.

6.3.2 The Booker is responsible for ensuring that they are authorised to provide the other person's information and to arrange the appointment.

6.4 Appointments for minors

6.4.1 Appointments for a minor should ordinarily be requested by a parent, a legal guardian, an authorised caregiver, or another person legally entitled to act for the minor.

6.4.2 By making such a booking, the Booker confirms that they are authorised to provide the minor's information and to arrange the appointment. Additional provisions concerning minors appear in the Privacy Policy.

7. No medical advice, medical disclaimer, and emergencies

7.1 Vizito provides appointment-booking and administrative software only.

7.2 Vizito does not:

  • provide medical advice;
  • diagnose medical conditions;
  • prescribe or recommend treatment;
  • provide emergency services;
  • guarantee a Specialist's qualifications;
  • guarantee the availability or quality of medical services;
  • supervise the specialist–patient relationship; or
  • guarantee any medical result.

7.3 Any medical or professional relationship is formed directly between the Specialist and the Patient. Vizito is not a party to that relationship and assumes no responsibility for it.

7.4 The Service must not be used to request emergency assistance or to obtain urgent medical advice. In an emergency, you should contact the applicable local emergency service immediately.

8. Bookings, cancellations, and rescheduling

8.1 A booking request submitted through the Service is a request to the relevant Specialist. Unless the Service or the Specialist states otherwise, a request is not confirmed until the Specialist or the Service confirms it.

8.2 Vizito does not guarantee the availability of any Specialist, service, appointment time, or location. Availability, prices, and services are determined and published by the Specialist and may change.

8.3 Cancellation, rescheduling, no-show, refund, and similar policies are determined by the relevant Specialist and applicable law. Vizito is not responsible for a Specialist's policies or for their application.

8.4 The Service may generate downloadable .ics calendar files and links for adding appointments to calendar applications, and may send booking confirmations, cancellations, rescheduling notices, and reminders by email, as described in the Privacy Policy. Vizito does not guarantee the delivery, timeliness, or accuracy of any such communication or file, and Users should not rely solely on them.

9. Fees, subscriptions, and future payments

9.1 The Service does not currently require payment, and paid subscriptions or payment functionality are not yet live.

9.2 We may introduce paid subscriptions, fees, or other payment functionality in the future. If we do, we will make the applicable terms and prices available before the paid feature applies to you, and your continued use of a paid feature will be subject to those terms.

9.3 If payment functionality is introduced, payment-card information would ordinarily be collected and processed directly by an authorised third-party payment provider under that provider's own terms, as described in the Privacy Policy. Vizito does not intend to store complete payment-card numbers unless expressly stated otherwise.

9.4 Any fees payable directly between a Patient or Booker and a Specialist for medical or professional services are a matter between those parties, and Vizito is not responsible for collecting, holding, or refunding them unless expressly stated otherwise.

10. Acceptable use and prohibited conduct

10.1 You must not use the Service to:

  • violate any applicable law, regulation, or professional rule;
  • infringe the rights of any person, including intellectual-property, privacy, or confidentiality rights;
  • upload or transmit unlawful, harmful, fraudulent, deceptive, defamatory, or misleading content;
  • upload content relating to another person without authority;
  • impersonate any person or misrepresent your identity, authority, or affiliation;
  • submit false, spam, or automated appointment requests;
  • interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure;
  • attempt to gain unauthorised access to the Service, other accounts, or connected systems;
  • probe, scan, or test the vulnerability of the Service without authorisation;
  • circumvent security, authentication, or access controls;
  • use robots, scrapers, or automated means to access or extract data except as expressly permitted;
  • reverse engineer, decompile, or disassemble any part of the Service except to the extent permitted by law;
  • introduce malware or other harmful code; or
  • use the Service to request emergency assistance or urgent medical advice.

10.2 We may investigate suspected violations and take appropriate action, including the measures described in section 17.

11. User content and uploaded documents

11.1 You retain any rights you hold in User content that you submit to or through the Service.

11.2 You grant Vizito a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, transmit, and display User content solely to the extent necessary to operate, maintain, secure, and provide the Service, and to comply with law. For content processed on behalf of a Specialist, this licence is exercised in accordance with the data-processing arrangement described in the Privacy Policy.

11.3 You are solely responsible for your User content and represent and warrant that you have all rights and authority necessary to submit it and to grant the licence in section 11.2, and that the content does not infringe any third-party rights or violate any law.

11.4 When a Patient or Booker requests an appointment, the relevant booking information and uploaded documents are made available to the selected Specialist, who may use and retain that information under their own privacy notice, professional duties, medical-record obligations, and applicable law.

11.5 We do not systematically review User content, but we may remove or restrict access to content that we reasonably believe violates these Terms, the Privacy Policy, or applicable law, or that may expose Vizito or others to liability or harm.

12. Intellectual property

12.1 The Service, including its software, design, text, graphics, logos, and other materials provided by Vizito (excluding User content), is owned by Vizito or its licensors and is protected by intellectual-property laws.

12.2 Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose.

12.3 Except as expressly permitted, you may not copy, modify, distribute, sell, licence, or create derivative works from any part of the Service, or use our names, logos, or trademarks, without our prior written consent.

13. Third-party services

13.1 The Service relies on and may interact with third-party services, including external calendar applications, email services, infrastructure and hosting providers, and websites linked by Specialists.

13.2 As described in the Privacy Policy, we use service providers including Vercel (website hosting, content delivery, deployment, and related infrastructure), DigitalOcean (cloud infrastructure, application hosting, databases, storage, backups, or related technical services), and Resend (sending transactional emails). The providers we use may change as the Service develops.

13.3 Third-party services process information under their own terms and privacy policies. Vizito is not responsible for the privacy, security, content, availability, or acts of any service that we do not control.

14. Privacy

14.1 Our collection, use, storage, sharing, and protection of personal data are described in the Privacy Policy, which is incorporated into these Terms by reference.

14.2 By using the Service, you acknowledge the Privacy Policy. Where a matter concerns personal data, the Privacy Policy governs the details, including the respective data-protection roles of Vizito and Specialists, international data transfers, retention, and privacy rights.

15. Disclaimers of warranties

15.1 To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.

15.2 Vizito does not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of harmful components, or that any content, communication, or file will be accurate, complete, or delivered.

15.3 Vizito makes no warranty regarding any Specialist, Patient, Booker, or the medical or professional services arranged through the Service, including any Specialist's qualifications, licensing, availability, conduct, or the quality or outcome of any service.

15.4 No advice or information obtained from the Service or from Vizito creates any warranty not expressly stated in these Terms.

16. Limitation of liability

16.1 To the maximum extent permitted by applicable law, Vizito will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Service or these Terms, whether based on contract, tort, or any other legal theory, even if advised of the possibility of such damages.

16.2 To the maximum extent permitted by applicable law, Vizito will not be liable for:

  • the acts, omissions, conduct, advice, or services of any Specialist, Patient, or Booker;
  • any medical or professional decision, treatment, diagnosis, or outcome;
  • the accuracy, lawfulness, or content of any listing or User content;
  • any missed, delayed, cancelled, or rescheduled appointment;
  • any failure or delay in the delivery of any communication, notification, or calendar file;
  • unauthorised access resulting from a User's failure to protect their credentials or devices; or
  • any act or omission of a third-party service.

16.3 To the maximum extent permitted by applicable law, Vizito's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the total amount, if any, that you paid to Vizito for the Service during the twelve months immediately preceding the event giving rise to the liability. Where you have paid nothing, Vizito's aggregate liability will be limited to the minimum amount permitted by applicable law.

16.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

17. Suspension and termination

17.1 You may stop using the Service at any time. Specialists may delete their account as described in section 18 and in the Privacy Policy.

17.2 We may suspend, restrict, or terminate your access to the Service, in whole or in part, with or without notice, where we reasonably believe that:

  • you have violated these Terms, the Privacy Policy, or applicable law;
  • your use poses a security, legal, or reputational risk to Vizito or others;
  • your use is fraudulent, abusive, or harmful;
  • suspension or termination is required to comply with law or a lawful request; or
  • it is otherwise reasonably necessary to protect the Service, its Users, or third parties.

17.3 Where reasonable and lawful, we will seek to provide notice and, where appropriate, an opportunity to remedy a violation.

17.4 On termination, your right to access the Service ceases. Provisions that by their nature should survive termination — including those relating to User content licences, intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — will survive.

18. Account deletion and changes to the Service

18.1 Account deletion

18.1.1 Specialists may delete their account using the account-deletion control provided within the Service. Deletion initiates the removal or deactivation of the booking page, account information, appointment information controlled through the account, uploaded documents, and related platform data, subject to the processes, timing, and limited exceptions described in the Privacy Policy.

18.1.2 Before deleting an account, a Specialist is responsible for exporting any appointment or patient information they are legally or professionally required to retain.

18.2 Changes to the Service

We may change, suspend, or discontinue the Service or any of its features at any time, temporarily or permanently. We will seek to give reasonable notice of material changes where practicable, but we are not liable for any modification, suspension, or discontinuation except as required by law.

19. Changes to these Terms

19.1 We may update these Terms to reflect changes to the Service, new functionality, new communication or payment methods, changes to service providers, legal or regulatory developments, or improvements to our practices.

19.2 The updated version will be published on this page with a revised "Last updated" date. Where a change materially affects your rights or obligations, we may provide additional notice by email, through the Service, or by another appropriate method.

19.3 Your continued use of the Service after an update takes effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Vizito and its representatives from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or relating to:

  • your use of the Service;
  • your User content or uploaded documents;
  • your breach of these Terms or the Privacy Policy;
  • your violation of any law or the rights of any third party;
  • for Specialists, the medical or professional services you provide and your professional, licensing, and medical-record obligations; and
  • for Bookers, your representation that you are authorised to act for another person or a minor.

21. Governing law and dispute resolution

21.1 The Service is provided by an Individual Entrepreneur established in Georgia and is intended primarily for Specialists operating in Georgia and the Dominican Republic.

21.2 Except where mandatory law provides otherwise, these Terms and any dispute arising out of or relating to them or to the Service are governed by the laws of Georgia, without regard to conflict-of-laws principles, and the courts competent for the place of Vizito's establishment will have jurisdiction.

21.3 Nothing in this section deprives you of the protection of any mandatory provision of the law of the country in which you are habitually resident, or of your right to bring proceedings before, or the jurisdiction of, a court that applicable mandatory law requires. Where you use the Service from the Dominican Republic or another jurisdiction, mandatory local consumer, healthcare, and data-protection laws applicable to you continue to apply.

21.4 Before commencing formal proceedings, the parties will seek in good faith to resolve any dispute informally by contacting us at support@mail.vizi.to and allowing a reasonable period for resolution.

22. Force majeure

Vizito will not be liable for any failure or delay in performing its obligations to the extent caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, government action, labour disputes, failures of utilities, internet or telecommunications networks, or failures or interruptions of third-party service providers.

23. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it will be severed, and the remaining provisions will continue in full force and effect.

24. Entire agreement

These Terms, together with the Privacy Policy and any additional terms we expressly present for specific features, constitute the entire agreement between you and Vizito regarding the Service and supersede all prior agreements and understandings on that subject.

25. Assignment

You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, financing, restructuring, or sale of assets, as described in the Privacy Policy. These Terms bind and benefit the parties and their permitted successors and assigns.

26. Waiver

Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision, and any waiver must be in writing to be effective.
